Terms of Service

1. Acceptance of Terms

By accessing or using the Tojumi Health platform (“Platform”), including our website at tojumihealth.com, web application at app.tojumihealth.com, and mobile applications (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Services.

2. Description of Services

Tojumi Health operates a marketplace platform that connects: (a) families (“Families”) seeking elderly care services in Nigeria, (b) care home operators (“Care Providers”), and (c) individual care workers (“Care Aides”). Tojumi Health is a technology platform and does not itself provide care services.

3. User Accounts

To use certain features of the Services, you must create an account. You agree to: (a) provide accurate, current, and complete information during registration, (b) maintain the security of your password, (c) promptly update your information if it changes, and (d) accept responsibility for all activities under your account.

Care Providers and Care Aides must complete identity verification (KYC) through our third-party verification partner before being approved on the Platform. Approval is at our sole discretion.

4. User Roles and Responsibilities

Families are responsible for providing accurate information about their care recipients and care requirements. Families acknowledge that Tojumi Health does not employ or control Care Providers or Care Aides.

Care Providers are responsible for the quality and safety of care services they provide, maintaining valid business registrations and licences, accurately representing their facilities, services, and pricing, and complying with all applicable Nigerian laws and regulations.

Care Aides are responsible for providing care services with professional diligence, accurately logging daily activities, maintaining valid certifications, and complying with all applicable laws.

5. Payments

Payments are processed through Paystack. By making a payment, you agree to Paystack’s terms of service. All payments are in Nigerian Naira (NGN). Tojumi Health charges a commission on each transaction, which is automatically deducted through split payments. Care Providers and Care Aides set their own rates.

6. Contracts

Care contracts are agreements between Families and Care Providers or Care Aides. Tojumi Health facilitates these contracts through the Platform but is not a party to the care agreement. Disputes between users should be resolved between the parties, though Tojumi Health may assist in mediation at its discretion.

7. Content and Data

Users retain ownership of content they upload to the Platform (photos, activity logs, reviews, etc.). By uploading content, you grant Tojumi Health a non-exclusive, worldwide licence to use, display, and distribute such content in connection with the Services. You must not upload content that is illegal, harmful, or violates the rights of others.

8. Ratings and Reviews

Users may leave ratings and reviews for other users. Reviews must be honest and based on actual experience. Tojumi Health reserves the right to remove reviews that are fraudulent, abusive, or violate these Terms.

9. Limitation of Liability

Tojumi Health is a technology platform and marketplace. We do not provide care services directly and are not liable for the actions, omissions, or negligence of Care Providers, Care Aides, or Families. To the maximum extent permitted by law, Tojumi Health shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may close your account at any time by contacting us at hello@tojumihealth.com. Termination does not affect any obligations that have already accrued.

11. Changes to Terms

We may update these Terms from time to time. We will notify registered users of material changes via email. Continued use of the Services after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria.
